ACCEPTANCE OF TERMS
This Agreement sets forth legally binding terms for your use of the ELI3 application ("App"). By using our App, you agree to be bound by this Agreement, whether you are a "Visitor" (which means that you simply browse our App) or you are a "Member" (which means that you have registered with our App). We may modify this Agreement from time to time, and such modification shall be effective upon its posting on our App. You agree to be bound by any modification to this Agreement when you use our App after any such modification is posted; it is therefore important that you review this Agreement regularly.
DESCRIPTION OF SERVICE
ELI3 provides a platform that assists parents in providing explanations to complex questions their children may ask, in a simple and digestible manner. It further provides various communication tools to facilitate dialogue between parents and their young children. These services, including any updates, enhancements, new features, and/or the addition of any new Web properties, are subject to these Terms and Conditions.
USER ELIGIBILITY
Our Services are available only to individuals who are eighteen (18) years of age or older and can form legally binding contracts under applicable law. You represent and warrant that you are at least 18 years of age and that all registration information you submit is accurate and truthful.
MAINTENANCE AND UPDATES
ELI3 may on occasion perform maintenance upon its platforms or lines of communication which may result in interrupted service of the App. ELI3 may at any time modify or discontinue, temporarily or permanently, any part of the App or services with or without notice.
USER RESPONSIBILITIES
User acknowledges and agrees that the App’s AI-generated content may produce outputs that are incorrect, offensive, or not related to the question asked. ELI3 disclaims all responsibility and liability for such content. User agrees that they assume all risks and consequences from the use of the AI-generated content.
LIMITATION OF LIABILITY
ELI3 LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE APP AND YOUR USE THEREOF. ELI3 MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE APP'S CONTENT AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY ERRORS, MISTAKES, OR INACCURACIES OF CONTENT.
In no event shall ELI3, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any errors, mistakes, or inaccuracies of content.
GOVERNING LAW AND DISPUTE RESOLUTION
These Terms and Conditions shall be governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any claim or dispute between you and ELI3 that arises in whole or in part from the App shall be decided exclusively by a court of competent jurisdiction located in Delaware.
MODIFICATIONS TO AGREEMENT
We may modify this Agreement at any time. If we make changes to this Agreement, we will post the revised Agreement on the Platform and update the “Last Updated” date at the top of this Agreement.
